Terms of Service

The purpose of this agreement is to explain the rules and conditions that will govern the relationship between Ingresse - Ingressos para eventos Espanha Sociedade Limitada (“Ingresse”) and the USERS of the platform for promotion and organization of events and making TICKETS available for purchase and sale on the INGRESSE.COM electronic address, applicable to all our licensing and maintenance services for the Ingresse platform made available to users, whether purchasers or sellers. By logging in, browsing and using our website or any other application through any means (generally referred to herein as “platform”), you accept to read and agree to the terms and conditions mentioned below (including the Policy Privacy Policy). Ingresse reserves the right to change the privacy policy and terms and conditions of service at any time. These changes will be communicated to users, but will be effective from the moment they are published in this browsing area.

1. Description of the service

Ingresse is an online technological platform made available to its users, purchasers and sellers, so that they can publicize their events and transact tickets among themselves.

Ingresse is not directly involved in the organization of any of the announced events.

By purchasing a ticket using the Ingresse platform, and on confirmation of payment, you enter into a direct contractual relationship (legally binding) with the organizer and acknowledge that it is solely and exclusively responsible for the advertised event, which is only publicized and sold through the use of Ingresse platform, which acts only as a licensor and intermediary of this technology/platform for its purchasing and selling users.

Furthermore, your access to, and use of, the Platform is subject to your acceptance of these Terms of Service.

1.1 Advantages to users

For users, Ingresse allows the secure purchase of tickets through the use of its platform, in addition to providing a unique browsing and research experience for the most diverse types of events publicized by different event organizers.

Ingresse platform has a database that allows you to search for relevant events based on your location, interests or circle of friends. On the platform you will find event suggestions based on your preferences and service usage data, collected, processed and protected in accordance with our Privacy Policy, receiving treatment in accordance with the law.

Ingresse may also send event suggestions based on this data to the email associated with your account, as well as information relevant to the events for which you have registered, which you can elect to stop receiving at any time.

2. Requirements for using the service

By using Ingresse, you declare your awareness that the service is provided “AS IS”, and that:

Users have sole and exclusive responsibility for the veracity of the information filled in their registrations, as well as for updating their registration information;

The organizers are fully responsible for organizing the events publicized on the platform. Therefore, the guarantee of the events, considering any liability for cancellations, changes, delays or any fact occurring during the event are the sole and exclusive responsibility of the respective organizers, while Ingresse simply acts as a facilitator of ticket sales; and

Payment operators are responsible for storing your banking or payment details in their database, as well as being liable for any losses arising from the use of third-party services to intermediate payments.

Finally, the user is liable for the integrity of their machines and networks, as well as, consequently, for fraud committed by third parties (hackers) that occurs during user’s payment processing, such as theft of bank or credit card details, or even viruses, trojans and any other type of malware installed on the user’s computer, mobile device, tablet or browser and which alters the details of the bank-issued invoice generated for payment.

The use of the service is conditional on user maintaining a friendly conduct with other users and refraining from attempting to use it for shady or criminal purposes, to circumvent, copy, or distribute without authorization any part of Ingresse’s properties, including, without limitation, brands, symbols, logos, slogans, interface and software associated with the platform.

You also represent that you have the means and meet the necessary requirements to access and use your account, as well as the tickets you purchase, such as a computer, smartphone, or other similar device connected to the internet, printer and minimum age for admission to the event.

3. Vouchers

Tickets are bearer documents. Thus, once issued, anyone can use them. For this reason, the safekeeping and conservation of tickets are the sole responsibility of the user.

The event organizer is solely and exclusively responsible for authorizing the possibility of transferring tickets for a given event.

It should be stressed, therefore, that there will be events on offer on the Ingresse platform with transfer enabled, disabled, limited until a certain date, as well as with other rules to be set by the organizer.

Ingresse does not determine the authorization or not and the rules related to ticket transfer, which will be set solely by the organizer.

Each ticket can only be used once. Once used, the exchange or reuse of the ticket will not be allowed under any circumstance, even by the duly identified user responsible for the purchase. In such cases, there will be no refund of the amounts either.

If you suspect that your ticket has been lost, or stolen, notify Ingresse immediately, so that it can intervene and help find the best solution for users.

At the sole discretion of the organizers, discount coupons will be made available for certain event tickets sold through the Ingresse platform. The discount will only be applied on the face value of the tickets.

The service fee charged by the Ingresse platform will be calculated and charged based on the face value of the tickets before the application of the discount coupon or any other applicable discount.

The processing fee, if applicable, will be calculated and charged based on the value of the tickets after the application of the discount coupon or any other applicable discount.

Discount coupons may be included in the purchase process of eligible tickets, before payment, in the field: ‘Discount coupon”, or, may be applied automatically in case of sharing a link to purchase tickets with the discount coupon already included.

The limitation on the use of discount coupons is also determined exclusively by the event organizers and, if the value of the discount is greater than that of the ticket, the face value of the ticket will be reset and only any applicable fees will be charged.

4. Entry to events

Purchasing tickets through the use of the Ingresse platform does not guarantee benefits or priority entry to the event venue.

You declare that you are aware and agree that the organizers may impose requirements or restrictions on entry to the event venue.

Responsibility for door operation and entry control at events is the sole and exclusive responsibility of the organizers.

5. Refunds of amounts

All purchases are final and under no circumstances will there be a refund of amounts paid for tickets or services provided by Ingresse, except in the following cases: (i) the event is cancelled; (ii) the event is rescheduled; or (iii) the event organizer expressly orders Ingresse to make the refund.

6. Security and privacy

6.1. Your password

Each user is responsible for the security of their password, and, consequently, for the transactions that use their password.

You can change your password at any time. We recommend that you avoid passwords such as birthdays and names, and use a password with at least eight characters, including numbers, symbols and letters, with upper and lower case letters.

You are also responsible for the security and maintenance of the email account associated with your account, which may be used for purposes of recovering your password.

6.2. Data collection and protection

When using Ingresse, you expressly authorize the collection and use of personal and social and economic data and browsing statistics, safeguarding the confidentiality of the information collected under the terms of our Privacy Policy.

6.2.1. Extrajudicial requests for breach of confidentiality

In case of a notification requesting disclosure of your registration or browsing data, including IP address, due to alleged use of the internet for illegal or illegitimate purposes, you will be notified of the request so that, within five (5) days, you can authorize or not the disclosure of the requested data.

Upon your timely authorization, Ingresse will respond to the notification, disclosing the requested data.

If you do not respond to Ingresse’s communication within the deadline or do not authorize the disclosure of your data, we will inform the requesting party that the information can only be provided upon a court order. In this case, you will be required to bear any costs, expenses, award, and costs of loss of suit and contractual fees imposed on Ingresse due to any legal action for disclosure of said data.

6.2.2. Judicial requests for breach of confidentiality

Ingresse will comply, without the need for prior communication to you, with any order from a competent judicial authority intended to determine the disclosure of your identity or any data provided to Ingresse or collected by it as a result of your use of the platform.

6.3. Email Correspondence

You acknowledge and agree that Ingresse may use the email address associated with your account to send administrative messages informing changes to the service, these terms of service, the privacy policy or any other changes applicable to your account. These messages are an integral part of the service offered and you will not have the option to refuse them.

You hereby authorize the sending of correspondence to the email address associated with your account with suggestions of attractions based on your browsing statistics and personal and social and economic data, which you can choose to stop receiving at any time.

Likewise, you hereby authorize the sending of correspondence to the email address associated with your account with pertaining information provided by the organizers of events in which you have registered, which you can choose to stop receiving at any time.

7. Liability

7.1. SERVICES ARE PROVIDED AS IS

Ingresse is an online technological platform made available to its users, purchasers and sellers, so that they can publicize their events and transact tickets among themselves. INGRESSE is not directly or indirectly involved in the organization of any of the announced events.

Hence, its services are offered “AS IS”, without this implying its direct or indirect involvement with the organization of events or its own guarantee that the events will be carried out under the terms disclosed by the organizers.

Ingresse only provides a communication and interaction platform that serves as a facilitating tool of rapprochement and contact between organizers and users interested in the events they advertise for ticket sales.

You acknowledge and agree that Ingresse does not select event organizers, does not monitor their activity, does not attest to their suitability, nor their legal, administrative, physical or economic capacity to carry out or promote the events they advertise, for their own account and risk, on the platform. You are also aware that the organizer’s data, including, but not limited to, your name, address and other event data, such as location, time, duration, etc., were provided by the organizer itself. By agreeing to purchase a ticket through the use of our platform, you acknowledge that Ingresse has no participation in the contractual relationship established between the guest (ticket purchaser) and the event organizer.

You declare that you are aware that the civil, criminal, commercial, environmental, fiscal, labor liability, liability of pecuniary or non-pecuniary nature, arising from the cancellation, delay, change, organization, security, as well as any fact occurring during the event is EXCLUSIVE of the respective organizers and can NEVER be attributed to Ingresse.

Ingresse does not offer any guarantee that the platform described in these Terms of Service will be available uninterruptedly, and is subject to partial or total interruptions, resulting from temporary lack of electricity, breakdown in concessionaires’ services, failures in the services offered by internet and telephone providers, strikes, riots, or any other facts that are not directly linked to the service and for which it assumes no liability.

7.2. Information supplied by third parties

As it is a social platform open to the public, Ingresse disseminates information published by initiative of third parties, users of the services it provides. Users of the platform assume exclusive responsibility for the use of Ingresse services and the consequences resulting therefrom, as well as for the veracity and good faith of any content submitted, published, reproduced, communicated, made available or displayed on their initiative on the website.

Although Ingresse reserves the right to remove criminal, offensive, discriminatory, or racist material, as well as to suspend accounts associated with any practices that violate these Terms of Service, you agree and understand that this does not imply any responsibility of Ingresse for prior control or inspection of material published by users of the platform.

7.3. Content managed by third parties

During your experience with Ingresse, you may find materials stored in external services, notably blogs, microblogs, social networks and multimedia content providers, which will be managed according to the Terms of Service and Privacy Policies of the respective services, with the entire content being under the responsibility of the services or users responsible for their publication, as the case may be.

7.4. External links

When using our platform, you may come across links to other websites recommended by our users, for which Ingresse does not assume any liability. The existence of links to third party websites does not imply support, recommendation or guarantee of availability or quality of content by Ingresse.

By clicking on these links, you declare to be fully aware that you will be leaving Ingresse domain and any guarantee offered by these terms of service or our privacy policy, and will be subject to the rules of the address to which you are directed, if any.

7.5. Payment operators

Payment operators directly manage payments made by their users and store their bank or credit card details, and for greater security, use independent services specialized in receiving and transferring payments.

Therefore, Ingresse does not assume any liability for errors, setbacks or losses resulting from the use of these services, including, but not limited to: loss of amounts, excess charges, delays in confirming payments or disclosure of data on the use of these services, registration, banking or confidential data provided during transactions.

Ingresse is not liable for frauds or any damage caused by the actions of third party fraudsters who, through shady means, steal users’ bank details and/or credit card details or any other form of payment. Nor is it liable for viruses, trojans, malware or any other malicious program installed on the user’s computer, tablet, cell phone, mobile device or browser and that modify the numbers generated for payment by bank-issued invoice.

Purchases made by users may be canceled at any time and the cause thereof cannot be declared by Ingresse, as the information is protected by bank secrecy. In such cases, users must contact their financial institution and/or debit/credit card operator with which they have a legal relationship.

Additionally, Ingresse may, at its discretion, request the cancellation of ticket purchases made by users when it suspects shady actions, such as, but not limited to, scalpers, for example. This measure is a protective measure seeking to ensure a greater distribution of tickets to end consumers.

8. Advertising

8.1. Use of the Ingresse brand

The license to use brands, symbols, logos or slogans owned by INGRESSE - INGRESSOS PARA EVENTOS S.A. is limited to advertising events that have tickets made available through the use of the Ingresse platform.

All promotional material for events that make tickets available for purchase and sale through the use of the Ingresse platform produced after the advertising of the event on the platform has started must contain the brands associated with Ingresse, or, at least, an indication of the local electronic address www.ingresse.com (http://www.ingresse.com/) to purchase tickets, or any other place that may replace it.

8.2. Promotional material on the website

Ingresse may establish limits on the size, dimensions and format of the advertisement to be displayed on the website.

The organizers hereby authorize Ingresse to adapt, according to its own criteria, advertising that does not comply with the graphic formats used on the website and in the application.

8.3. Authorization to exploit copyright or industrial property rights.

The organizers declare that they own or are authorized to use any brands, symbols, logos, slogans, or any other objects protected by copyright and intellectual property laws that are disclosed on Ingresse.

The same statement is valid for any advertising material in which any of the brands, symbols, logos or slogans associated with Ingresse are used.

9. Processing of news of infringement of copyrights or intellectual property rights and press contact

If a third party believes that their copyright or part of their intellectual property has been used without authorization or in non- compliance with the authorization granted, they shall contact Ingresse through the email contato@ingresse.com.

On proof of violation or determination of reasonable doubt about the authorization to use the disputed property, you hereby authorize Ingresse to promote its immediate removal, regardless of prior communication.

Requests for contact by the press and media shall be sent to the email imprensa@ingresse.com.

10. Violations of the Terms of Service

Any violations of these terms of service or attempts to use the platform, tickets or any property of INGRESSE - INGRESSOS PARA EVENTOS S.A. for illegal purposes are subject to suspension or cancellation of the associated account(s), at the discretion of Ingresse and without prior notice, without prejudice to the applicable legal measures.

This includes, but is not limited to: attempts to circumvent (hack or crack) the platform’s security; attempts to obtain users’ confidential data; distribution of viruses or other malicious software; frauds; insulting, defamatory or slanderous conduct; event cancellations or changes; infringements of copyrights or intellectual property rights; among others.

11. Limitation period

Any judicial or administrative claims arising from the provision of services subject to these Terms of Service or the associated Privacy Policy shall be filed within ninety (90) days after the event that caused them. 

12. Termination and Effectiveness of the Terms of Service

These Terms of Service is effective between the parties as long as the service provision relationship between user and Ingresse subsists, which starts on the effective registration on the website and can be terminated by:

Cancellation of registration at user’s request and discontinuance of use of the services;

Cancellation of registration due to violation of the Terms of Service or the Service Agreement;

Death of the user, as proven by a death certificate.

Ingresse also reserves the right to interrupt the provision of services in part or in full, if their operation is no longer commercially viable.

The termination of the provision of services does not imply waiver by either party of the credits to which they are still entitled.

13. Applicable legislation

These Terms of Use are governed and interpreted in accordance with Spanish law.
